Terms and conditions for using our website and services

1. Acceptance of Terms

By accessing and using the us-Sunnah Foundation website ("Website") located at www.ussunnah.org and making donations through our platform ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Website or Services.

us-Sunnah Foundation ("we," "our," or "us") reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Website or Services after changes are posted constitutes acceptance of the modified Terms.

2. About us-Sunnah Foundation

us-Sunnah Foundation is a registered 501(c)(3) nonprofit organization dedicated to supporting orphans, refugees, and communities in need through humanitarian aid and charitable programs. Our primary focus includes:

  • Monthly support for orphans in Indonesia (food, education, healthcare)
  • Rohingya refugee relief and shelter programs
  • Waqf (endowment) management for sustainable charitable giving
  • Emergency relief and humanitarian aid

All donations to us-Sunnah Foundation are tax-deductible to the extent permitted by law. We operate under a true 100% donation policy where all operational costs are covered by endowment income.

3. Donations

3.1 Nature of Donations

All donations made through our Website are voluntary, charitable contributions. When you make a donation, you are making an unconditional gift to us-Sunnah Foundation. You acknowledge and agree that:

  • Donations are not payments for goods or services
  • You are not purchasing any product or receiving any tangible item in exchange for your donation
  • Donations represent charitable intent and humanitarian support for our mission
  • Once submitted, donations are immediately processed and allocated to our programs

3.2 Donation Processing

All donations are processed securely through Stripe, our PCI-DSS compliant payment processor. By making a donation, you:

  • Authorize us to charge the specified amount to your payment method
  • Confirm that you are the authorized user of the payment method
  • Agree that the transaction information you provide is accurate and complete
  • Acknowledge that donations are processed immediately upon submission

3.3 Tax Receipts

We provide tax receipts for all donations via email to the address provided. Annual tax summaries are available through your donor account. It is your responsibility to maintain records for tax purposes and consult with a tax professional regarding deductibility.

3.4 Campaign Designations

While we make every effort to honor your campaign designation (e.g., Orphans, Rohingya, Waqf), we reserve the right to redirect funds to similar programs if:

  • The designated campaign is fully funded
  • The designated campaign is discontinued
  • Urgent needs arise that require reallocation
  • Legal or regulatory requirements necessitate changes

In such cases, funds will be used for purposes as close as possible to the original designation, consistent with our charitable mission.

4. Recurring Donations

4.1 Subscription Terms

When you establish a recurring (monthly) donation, you authorize us to automatically charge your payment method on a monthly basis until you cancel. Your subscription will continue indefinitely until cancelled.

4.2 Managing Your Subscription

You have full control over your recurring donations through your donor account. You may:

  • Cancel: Stop all future charges immediately
  • Pause: Temporarily suspend charges (resumable at any time)
  • Modify: Change the donation amount for future charges
  • Update Payment Method: Change the card or payment method used

Changes take effect from the next billing cycle. There are no fees or penalties for cancellation.

4.3 Failed Payments

If a recurring payment fails, we may attempt to process the payment again. If payment continues to fail, your subscription may be paused or cancelled. We will attempt to notify you by email of any payment issues.

5. Refund Policy

As a charitable organization providing humanitarian aid, donations are generally non-refundable. Charitable donations are fundamentally different from commercial transactions—funds are immediately allocated to support our beneficiaries and programs.

  • We do not provide refunds for change of mind or donor's remorse
  • Refunds may be considered only for documented errors, duplicate charges, or unauthorized transactions
  • Any refund requests must be submitted within 7 days of the donation
  • You have full self-service ability to cancel recurring donations at any time

6. User Accounts

6.1 Account Creation

You may create an account to manage your donations and access your donor portal. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept full responsibility for all activities under your account

6.2 Account Security

We use passwordless authentication (secure login links) sent to your email address. You are responsible for maintaining the security of your email account. We are not liable for any loss arising from unauthorized access to your account.

7. Acceptable Use

You agree not to:

  • Use the Website for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any portion of the Website or its systems
  • Interfere with or disrupt the Website's operation or servers
  • Submit false, misleading, or fraudulent information
  • Impersonate any person or entity or misrepresent your affiliation
  • Use automated systems to access the Website without our permission
  • Engage in any activity that could harm our reputation or mission

8. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, images, videos, and software, is the property of us-Sunnah Foundation or its content providers and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written permission, except for personal, non-commercial use such as sharing our content on social media with proper attribution.

9. Third-Party Services

Our Website uses third-party services including Stripe (payment processing), Supabase (authentication), and various analytics providers. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, US-SUNNAH FOUNDATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • Your use of or inability to use the Website or Services
  • Any unauthorized access to or alteration of your data
  • Any third-party conduct or content on the Website
  • Any errors, mistakes, or inaccuracies in content

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU DONATED IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless us-Sunnah Foundation, its officers, directors, employees, volunteers, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Website or Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content or information you submit or transmit through the Website

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Website shall be resolved as follows:

  1. Informal Resolution: We encourage you to contact us first to resolve any issues informally
  2. Mediation: If informal resolution fails, either party may request non-binding mediation
  3. Arbitration: Any remaining disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any legal proceedings shall be conducted in the state or federal courts located in California.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us-Sunnah Foundation regarding your use of the Website and Services.
